Stylistically significant variation of phraseological units in English and Russian

Alibekova D.M.

Abstract

in connection with the stylistic characteristics of phraseological units, linguists face a rather difficult question, which boils down to the phraseological norm, since normativity is one of the main signs of the literary character of the language. It is noted that in both languages, variation and norm are interrelated, since the choice of an option involves taking into account the norm, and the norm is determined by the presence of several options. Variability is an indicator of the processes occurring in a language when it is being normalized. These are mainly grammatical variants, which are functionally equivalent in most two languages, so there is a balance between them. There are various types of phraseological units in English and Russian: lexical, morphological, phonetic, syntactic, stylistic, quantitative, and others.

Semantic features of onyms of Avar folk tales

Bagomedov M.R., Abdulomarova M.M.

Abstract

the article discusses the semantic features of the Avar language onyms recorded in folklore works, namely in Avar folk fairy tales. The relevance of the research topic is predetermined by the fact that the study of folklore proper names in this aspect reveals the historical, cultural and linguistic details of the Avar people and is the key to understanding its national and cultural uniqueness. It is also determined by the need to analyze folklore onyms to identify their structural and semantic features. The main goal of the study is to consider the semantics of toponyms and anthroponyms recorded in Avar folk tales based on a selection of material from the book "Collection of Folklore Monuments of the Peoples of Dagestan" (in twenty volumes). The methodological basis of our research is the concepts that reveal the problems of interaction between history, culture and language. The linguistic material of the Avar folklore works determined the methods of research. In the study, the method of synchronous analysis is most often used, descriptive and comparative-historical methods are also used. The practical significance of the work is that the results of the study can be applied in school and university courses of the modern Avar language (in the section "Lexicology"), as well as in the study of Avar folklore in the course of native literature. They can be used in the creation of a dictionary of folklore proper names.

The role of vernacular and argot in colloquial French speech

Stramnoy A.V., Glebova E.A.

Abstract

in any language there has always been and will be Argotic lexicon that contributes to the enrichment and development of the language. The translation of fictional literature from French into Russian is often a very complicated process, due to a poor knowledge of the vocabulary used in conversational speech. More precisely, these difficulties are caused by the lack of knowledge of the reduced register vocabulary. Our work is focused on the most stylistically-colored lexicon of the contemporary French language, used both in oral speech and in the works of French writers that, in our view, will help to expand the functional and stylistic boundaries of French language learners. The relevance of this study is determined by a great necessity to master intercultural communication skills and abilities to comprehend the spoken foreign language. The purpose of the research is to identify the argotic vocabulary and vernacular in the fictional works of French authors of the 20th century, as well as in the press. The theoretical and practical significance of the work can be defined as the need for a broader and more diverse study of the French language. It is necessary to comprehensively describe the cultural, social and territorial aspects of the spoken language. The role of youth word-creation should also be noted.

Wang Z.

Abstract

this article provides an in-depth analysis of changes in the concepts of new youth in the context of epochal changes and the logical factors behind them by examining four main drivers: information technology, economic transformation, cultural synthesis and transformation of social roles, which reveal the roots of the emergence of the concepts of new youth. Using qualitative research methods, the article collected and analyzed typical examples from numerous literature sources, highlighting four trends in the picture of new youth concepts: the aesthetics of distance in the era of superficial socialization, an autonomous working concept, going beyond the role of the "hard worker", significant liberation from traditional views on marriage and fertility, and a free consumer concept, under the influence of influenced by the philosophy of "lying down and doing nothing." On this basis, the article further interprets new value orientations, such as "self-satisfaction", encouraged by new youth, and their profound impact on the social structure, cultural concepts, and models of economic development. The discourse of Soviet journalism during the Great Patriotic War

Kurguzov D.A.

Abstract

the article is devoted to a comprehensive analysis of the discourse of Soviet journalism during the Great Patriotic War. The study aims to identify the features of media formation under conditions of an extreme socio-political crisis, as well as to assess the impact of journalistic rhetoric on the mobilization of the population and the formation of patriotic sentiments. In wartime conditions, journalism became an indispensable tool of state propaganda. The discourse under review is characterized by a combination of official ideological statements, emotional expression, and deliberately constructed argumentation that allowed for the shaping of public consciousness, the strengthening of patriotism, and the moral spirit of citizens. The aim of the article is to identify the characteristics of strategic journalism of that period and to determine its role within the information policy of the Soviet state. To achieve this aim, the methods of historical-discursive analysis, semiotics, and content analysis were employed, allowing for the tracing of the evolution of linguistic constructions used in the media. Both printed publications and radio broadcasts, the main channel of communication during the war, are analyzed. In addition, a comparative analysis of materials from different years was conducted, which made it possible to trace the dynamics of changes in rhetoric under shifting military circumstances. The study found that Soviet journalism actively shaped the “military image of the enemy,” using symbolism, emotional labels, and metaphorical images to create the only possible worldview. Special attention is paid to the transformation of the genre structure of the texts, which contributed to the perception of the information as an essential patriotic manifesto. Both the persistence of certain rhetorical templates and their evolution under the influence of military events were noted.

Integration of modern Russian rock and rap compositions as cultural heritage products into the educational process

Kabakova A.S., Znamenshchikova D.A., Chupina A.A.

Abstract

the problem of the scientific article is the lack of an accurate genre definition of rock and rap compositions, which would allow them to be considered within the framework of the method of integrating cultural heritage into the learning process in literature lessons in the 11th grade. The interest in the problem is due to the greatest demand for rap and rock relative to other musical genres in this age group of schoolchildren. The purpose of the article follows from this: to identify the features of poetry in specific works of currently popular representatives of hip-hop and rock culture and to prove the expediency of their use in literature classes in 11th grade. The methodological basis of the article is compositional analysis, partly biographical and partly semiotic research methods. Research materials: federal work program of secondary general education in literature. Considered musical compositions: «How beautiful winter is in your room» by Jesus, «Smile at the Sun» by T-Fest. The article proves the presence of poetic techniques in the lyrics of the songs cited above by the authors; in particular, the observance of poetic size, the presence of rhyme, means of expression and the author's intention. The work reveals similar functions of rock and rap songs and literature – educational, communicative, aesthetic, socializing and other tasks, which allows selectively including products of modern musical culture in the learning process. The authors conclude that the method of including rock and rap compositions as the results of the cultural life of society in the educational process ensures the involvement of students, the implementation of the necessary element of moral education in the lesson, the exchange of knowledge in the context of culture developing in the present, and therefore more fruitful learning.

A variation of the archetypal plot «deal with the devil» in D. Keyes' novel «Flowers for Algernon»

Nuykina E.I., Staritsyna Y.A.

Abstract

the presented article examines the transformation of the archetypal plot «deal with the devil» in world literature, in particular, in the novel by D. Keyes «Flowers for Algernon». The analysis of the plot and compositional organization of the novel allows us to conclude that the architectonics of the work contains the archetypal plot «deal with the devil», which is also semantic. In addition, the identification and analysis of the archetypal basis of the novel, as well as the specifics of the transformation of this archetypal plot in the work, reveal the presence of other archetypal plots (the plot of human creation, the plot of «descent into hell»). The elements of the text that are axiomatically present in the structure of the archetypal plot itself are considered: the acute desire of the protagonist Charlie Gordon to acquire new abilities, the conclusion of an agreement with the devil, personified by images of false scientists, the subsequent realization of the disastrous consequences of such a deal and the experience of his fall. Special attention is paid to the complex of motives traditionally associated with a deal with evil spirits (the motive of a sick soul, the motive of fear, the motive of violence and the motive of blood), as well as the mythological images of the labyrinth and the flower as cosmological models of the universe.

Stylistic techniques and tactics of linguistic personality in political discourse (using the example of V.M. Molotov's speeches)

Borodina M.A., Salnikov O.V.

Abstract

the article discusses the importance of the sphere of political communication in public consciousness. The linguistic discursive personality of a politician plays a crucial role in determining public sentiment and the civic position of peoples. This is true both in relation to modern politicians and to political figures of the Soviet past, such as V. Molotov, A. Gromyko, A. Sobolev. The study of the linguistic discursive personality in political discourse allows for a deeper understanding of the dynamics and features of political communication in various historical and cultural contexts, which can be useful for specialists seeking to assess the influence of linguistic strategies on political processes and public consciousness. Thus, the study of linguistic personality, as in the case of Vyacheslav Molotov, helps to reveal the complex relationships between linguistic personality and political discourse, and also, contributes to a deeper understanding of the mechanisms of political communication and its impact on society. The discursive personality of Soviet politicians and diplomats is associated with the influence of extralinguistic factors, with the ideologemes of the Soviet era, as well as with the functional range of ideological attitudes. In the texts of speeches of Soviet diplomats, it was obligatory to contrast opposing political systems. That is why in the speeches of V.M. Molotov, A.A. Gromyko and A.A. Sobolev the model of "Contrast, parallelism" is actualized, which is the most significant in quantitative terms.

Exam media codes in a specialized journalistic text (based on Uchitelskaya gazeta)

Popova E.A.

Abstract

the article examines media codes (paradigmatic elements of media discourse) within the framework of Russian pedagogical axiology using the past two decades of Uchitelskaya gazeta (Teacher’s newspaper) coverage of the Unified State Exam as a case study. By focusing on axiological aspects, Uchitelskaya gazeta presents media codes not merely as monological text production, but as a polylogical sphere in civil society’s three-layered space of ethical reflection and sociocultural interaction. This research is relevant due to the critical need for in-depth analysis of pedagogical journalism and its ability to effectively communicate and convey the meaning of culturally specific elements to a diverse audience. The goal of this study was to establish the influence of media codes (using the example of the “exam” concept) in pedagogical journalism on the formation of the system of values in the society and social comprehension of new culture-specific elements in the educational process. This context sees axiology analyzing and identifying educational values as expressed in specialized educational texts’ media codes. The metaphorical basis of media codes is influenced not only by the genre conventions of articles and discussions but also significantly by the creative staff of a certain newspaper or magazine associated with history and traditions of Russian pedagogical printed media.

TV series as a universal method of modern storytelling

Kalakutskaya E.A.

Abstract

the article examines the TV series as a universal method of modern storytelling. Two types of storytelling in modern television are identified – traditional narration of real or fictional dramatic events within the framework of a nation, locality, time, family. hero and transmedia formation of an entire space in which the hero exists, with its own laws, rules, canons, while media products can exist both separately and complement each other. It is noted that images and events in storytelling are implemented mainly in TV series, since they allow you to tell a story over a longer period. Using the example of the TV series "Yellowstone" (5 seasons), the features of storytelling are considered. Three main plots are identified that can be traced in the series within the framework of storytelling. The main plot lines are highlighted, presented in the format of individual stories. It is concluded that the series as a universal method of modern storytelling is built around a certain structure of the plot and plot lines.

Structural and pragmatic features of English-Hindi code switching in English-language media texts of India

Korosteleva V.I.

Abstract

the article presents a comprehensive analysis of structural and pragmatic features of code-switching (CS) between English and Hindi in English-language media texts of India. Based on a corpus of more than 1000 text units from 2020-2024, the study identifies the main structural types of CS (intrasentential, intersentential, tag switching), explores patterns of morphosyntactic integration of English elements into the Hindi system, and establishes correlations between structural types of CS and their pragmatic functions. Special attention is paid to multimodal integration in the context of digital transformation of the media environment. The research determines dynamic trends in CS development during the studied period: an increase in the proportion of intrasentential CS, growth in structural diversity of verbal constructions, strengthening influence of the English syntactic model, and significant growth in multimodal integration. The proposed integrative approach to CS analysis takes into account both grammatical and pragmatic factors of bilingual constructions functioning in modern media discourse.

Research on JiaPpingwa's work in Russia

Xue H.

Abstract

this article provides an overview of existing scientific publications devoted to the study of Jia Pingwa's work in Russia. The article examines the perception of the image of this writer by Russian researchers, the current state of study of his work, as well as the problems that arise when translating his works. Jia Pingwa's work, as a representative of the "root-seeking literature," is attracting growing attention from Russian scholars, but its study and translation remain relatively limited. Russian researchers note that Jia Pingwa has his own unique style, which harmoniously combines elements of traditional Chinese culture and Western modernism, thereby creating a unique artistic space. In addition, the comparative study of Jia Pingwa and Russian writers is a promising area that requires further in-depth study. Nevertheless, the lack of Russian translations of Jia Pingwa's works prevents their wide dissemination and further research in Russia.

The gender of the French noun and the means of its grammatical expression in a comparative historical aspect

Baluta A.A., Epifantseva N.G.

Abstract

this article examines the means of grammatical expressions of the gender category in modern French, examines the history of the formation of the modern binary French grammatical gender category from the perspective of diachrony, and examines the ways in which the neuter forms of Latin are lost. In the course of the study, it was possible to establish that the gender category belongs to the so-called iterative categories, which extend to several parts of speech: gender is inherent in a noun with which an adjective, an ordinal number, as well as a pronoun, partly a verb. In classical and early vernacular Latin, the gender category was three-component, but over time it was transformed into a binary category in the vernacular, which became possible due to the gradual loss of neuter forms. This process took place after the emergence of doublet forms of endings of different genders, as well as through the reinterpretation of some grammatically homonymous forms in favor of masculine and feminine genders. It can be assumed that the category of the neuter gender, as well as many other grammatical phenomena, was gradually abolished in the Romance languages in the general trend of the desire for analyticism of this language group and, in general, is one of the signs of increased analyticism in any language. If some Romance languages have rudimentary and preserved separate forms of the neuter gender or traces of them, they usually go back to the forms of classical or folk Latin. As a result of the development of analytical trends in the structure of the French language, the article and its functional analogues, determinants, have become the main indicator of the grammatical category of gender. Along with the main analytical means, there are morphological means: suffixes, as well as alternating designations of male/female faunonyms and anthroponyms. The suffix designation of the noun genus reflects a historical tradition dating back to the Latin language. The modern system of suffix formations is characterized by a large number and variety of forms with the main criterion of their division by gender into two subgroups. The definition of the genus of nouns is complicated by its conditional nature – the gender meaning of the genus is confirmed by biological sex only in the names of creatures (animate objects), for names of inanimate objects it has no gender motivation. In modern formation of feminine forms, the tendency of folk word-making has manifested itself by analogy with vernacular forms.

Linguistic and cultural representation of time and space in Russian and Chinese linguistic worldviews

Song J.

Abstract

this study is devoted to a comparative analysis of the linguistic and cultural representation of the categories of time and space in Russian and Chinese linguistic worldviews (LWV). At the theoretical level, key parameters of analysis have been identified, including dominant conceptual models, aspects of perception, and linguistic means of objectification. It has been established that the Russian LCP is characterized by a dynamic perception of time, an emphasis on linear progress, and extensive exploration of space, while Chinese linguoculture demonstrates cyclical temporal representations, hierarchical spatial relations, and the sacralization of loci. The identified differences are determined by the historical experience, value orientations, and mental attitudes of the peoples. The study confirms the thesis of the cultural conditioning of the basic categories of cognition and contributes to the development of the typology of LCP and the methodology of comparative linguoculturology.

Structural and semantic features of binomials in naval terminology

Filippova E.N.

Abstract

this article presents the theoretical aspects of exploring one of the types of collocations – binomials. A number of foreign and domestic studies on this problem are considered. An attempt is made to identify the most significant features of binomial combinations. They serve as a basis for the implemented analysis of structural-semantic forms of binomials in naval terminology; the authors characterise how key components are linked and specify the principles of their succession. The practical part presents the results of the analysis of 178 binomial units identified by continuous sampling in the instructional literature in profile 26.05.04 “Application and operation of technical systems of surface ships and submarines”. The types and subtypes of binomials are considered in terms of their semantics as well as the frequency of occurrence of their components in the Russian National Corpus. The authors substantiate the significance of the present work for teaching the professional language and describe the methodology and results of the experiment showing that the memorisation and recognition of binomial terms takes place much faster and easier than that of the terms having no collocative variants.

A study of conceptual metonymy in Chinese political discourse based on the cognitive theory of metonymy

Cao L.

Abstract

in this article, within the framework of the cognitive theory of metonymy developed by E.V. Paducheva, a study of conceptual metonymy is conducted based on Reports on the work of the Chinese government over the past three years. As a result of the study, three characteristic metonymic transformations in Chinese political discourse were identified: CONTAINER ? CONTAINED, CONCRETE ? ABSTRACT, TIME ? EVENT, which demonstrate such key characteristics of Chinese political discourse as conciseness and clarity. The study not only expands the explanatory potential of Paducheva’s theory of metonymy, but also contributes to a deeper understanding of Chinese political discourse, and is also of practical value for its adequate translation into other languages.

The role of new media in foreign communication: a comparative analysis of the communication effects of China and Russia

Guo Z.

Abstract

the article examines the role of new media in interstate communication using China and Russia as case studies. The primary goal of the study is to identify the key communication effects of new media and provide a comparative analysis in the context of the cultural, political, and social characteristics of the two countries. The research material includes a content analysis of 150 publications from social networks and online media, as well as survey results conducted among audiences from both countries. The theoretical basis of the study incorporates media effects concepts and intercultural communication theories, applied using a comparative-analytical method. The findings demonstrate that new media significantly influence public opinion formation, contributing both to the enhancement of cultural dialogue and the creation of potential zones of misunderstanding. Specifically, new media in China is often utilized to promote national culture and politics, whereas in Russia, the emphasis is placed on civic initiatives and public self-expression. The authors conclude that despite their differences, both countries leverage new media to strengthen their positions on the international stage, underscoring their crucial role in contemporary global communication.

the article examines the literary language as the basis for the formation of a speech culture. The topic is relevant due to the need for modern teachers to constantly search for methods and means of introducing young people into the world of culture. The level of speech culture among young people is at a fairly low level, which leads to a number of problems and a general drop in the rating of modern people. The purpose of the study is to determine the significance of the literary language in the process of forming a speech culture. In the course of the work, the works of Russian and foreign authors devoted to the problems of speech culture, as well as the use of the Russian language in the process of developing communication skills and competencies, were studied. It is concluded that studying a literary language allows one to understand and correctly use existing norms and rules in practical speech. Thus, the literary language is of great importance in the formation of a culture of speech, since it is a certain “model” of the use of words.

Theoretical foundations of studying the linguistic personality of a lawyer

Gilyazova A.E.

Abstract

conceptual changes in the linguistic paradigm over the past decades, as well as the progress of such areas as cognitive, corpus, and functional-semantic linguistics, have allowed researchers to take a more comprehensive approach to the study of language and discourse of linguistic personality, both individual and collective. Nowadays, interest in this topic is shown not only by linguists, but also by specialists in related fields: psychology, pedagogy, conflictology and sociology. The author comes to the conclusion that the lawyer's special vocabulary includes evaluative concepts characteristic of regulatory legal acts that may be misinterpreted by specialists from other fields, since they are subject to ambiguous interpretation, which requires explanations from a professional.

Challenging major transactions by participants in business companies in Russian law: theory and practice

Sumin M.D.

Abstract

the article analyzes the issues concerning the contestation of major transactions by participants of business companies with the application of theory and practice of the Russian legislation. In accordance with paragraph 4 of Article 78 of the Law «On Joint-Stock Companies» and paragraph 8 of Article 46 of the Law «On LLC» the transaction beyond the normal business activities of the company as a condition for its contestation on the grounds of large-scale nature assumes that such a transaction does not meet the criterion of transaction typicality (the transaction is not accepted in the activities of this company or other business entities engaged in similar types of activities) or the criterion of economic consequences of the transaction (the transaction leads to the termination of the company's activities, change of its type or a significant change in the economic consequences of the transaction). The article explores the theoretical and legal foundations as well as the practical aspects of disputing major transactions conducted by business entities. It analyzes the grounds for declaring such transactions invalid and examines the procedural mechanism by which shareholders or participants may challenge them in court. Special attention is given to the legal classification of major transactions as contestable, the calculation of limitation periods, the allocation of the burden of proof, and the role of shareholders’ agreements. Current judicial practice is reviewed, and suggestions for improving legislation are proposed. The findings are based on the analysis of regulatory acts, judicial clarifications, and academic literature.

The corpora delicti of “calls” in the Criminal Code of the Russian Federation: signs, types and problems of differentiation

Anisimova I.A., Starodubtseva M.A., Yakusheva T.V.

Abstract

the article is devoted to the identification of similarities and differences in the corpora delicti of crimes under Art. 2052, 212, 280, 2801, 2803, 2804, 2842 and 354 of the Criminal Code of the Russian Federation, which contain the prohibition of differently directed calls. The purpose of the study was to develop doctrinal provisions on the concept and signs of the general corpus delicti of criminal calls, as well as criteria for distinguishing their criminalized types. Within the framework of the set goal such scientific and practical tasks, as the criminal-legal characterization of the corpus delicti of calls, identification of the features of the call as a type of criminogenic information, determination of the place of information containing the call in the corpus delicti, analysis of the substantive difference of related norms on calls and resolution of their competition were solved. The study has shown that the Criminal Code of the Russian Federation has inconsistency of terminology in describing the corpora delicti of calls, lack of clear criteria for distinguishing between the types of calls prohibited and excessive “fragmentation” of norms on criminal liability for calls. It is concluded that it is necessary to unify criminal legislation in terms of the prohibition of calls. The results of the study are aimed at effective counteraction to crimes of terrorist, extremist and subversive orientation, can be used in law enforcement, law-making activities, as well as for scientific and educational purposes.

Normative focus of the bill of lading

Khabibulaev A.K.

Abstract

this article discusses issues related to the regulatory focus of the bill of lading in the Northern Sea Route (NSR) system. Attention is drawn to the full promotion of the bill of lading in connection with the full responsibility of the guarantor for sea transportation throughout the freight. Attention is paid to combining the promotion of the bill of lading with its normative focus in conditions of disregard for international law. The expansion of the NSR in the Yenisei direction with the possibility of legal regulation by the legislator in the areas of river terminal management was noted. It is pointed out that the bill of lading promotion system has a very complex design and requires a combination of both regulatory legal and regulatory technical regulation. Proposals are given on the normative focus of the bill of lading in the form of the publication of a new Federal Law containing norms for the transportation of goods, taking into account transshipment at these terminals and excluding the increase in the tax burden on the sides of the bill of lading. An additional concept (type) of a bill of lading has been introduced as a "safe wayside bill of lading."

A modern mechanism for protecting the interests of owners of land plots intended for individual housing construction (land users, landowners) when establishing a zone with special conditions for the use of territories in Russia

Sokolov D.V.

Abstract

the article discusses the mechanism for protecting the interests of owners of land plots intended for individual housing construction (IHC) (land users, landowners) when establishing a zone with special conditions for the use of territories (ZSCUT) in Russia. Based on the analysis of literature and judicial practice, the problems of protecting the interests of owners of residential housing land plots in the establishment of ZSCUT have been identified. It is determined that when defending interests in court, the latter make contradictory decisions. In addition, despite the fact that the owner of the land plot is the weaker and more vulnerable party in land disputes of this kind, it is the owner of the plot who is responsible for proving the fact of having knowledge of the existence of a restricted area. At the same time, in the previously existing legislation, there was no obligation for the entity establishing the ZSCUT to enter such information into the cadastral register, which entailed in the present legal problems of the turnover of land plots subject to restrictions imposed in connection with the ZSCUT. In conclusion, measures aimed at solving the problems of protecting the rights of owners of residential housing land plots are proposed.

Bortnikov D.M.

Abstract

the article is devoted to the problem of defining criteria for lawful conduct in a digital society. The purpose of this study is to identify the problems of defining criteria for distinguishing lawful conduct of individuals from other types of conduct in a society undergoing digitalization. In the course of the research, general scientific and specialized methods of cognition were applied, including formal legal methods, methods of analysis and synthesis, modeling. As a result of the analysis, the author draws a number of conclusions. Firstly, lawful conduct, distinguished from unlawful and unlawful types of conduct, is associated not only with compliance with the norms of legislation, but also with the onset of a socially useful result; secondly, the doctrinal criteria of lawful conduct of a person are highlighted, consisting in consistency, regulation by legislation, approval by society and compliance with the law; thirdly, it is defined that the digitalization of modern society leads to the transformation and fragmentation of individuals' legal consciousness, which affects their conduct; fourthly, conditional behavioral segments of lawful conduct are identified, based on the fragmentation of individuals' legal consciousness and the formation of legal consciousness. In conclusion, the author reflects the assumption that, in the context of transformation, it is not yet possible to identify stable criteria for lawful conduct, since not even all categories of relations arising in connection with digitalization are reflected in legislation. The possibility of practical application of the research results lies in the fact that the identified behavioral segments can serve as a starting point for developing criteria for lawful conduct and the possibility of distinguishing it from unlawful and unlawful conduct in the context of the digital transformation of society.

Baranov D.A., Valov K.D.

Abstract

the article is devoted to the analysis of legal contradictions arising in the process of digital transformation of the education system in the Russian Federation. Special attention is paid to the conflict between the constitutionally established right to education and the freedom of entrepreneurial activity, in the context of the active introduction of digital educational platforms. The purpose of the study is to identify regulatory gaps that threaten accessibility and equality in education, as well as to analyze the legal status of subjects of the digital educational space. In the course of the work, the provisions of the Constitution of the Russian Federation, the Civil Code of the Russian Federation, legislation on education, personal data and protection of competition were analyzed. Formal legal, comparative legal, and critical analytical methods served as the methodological basis. The authors identify cases of an extended interpretation of the rules governing the processing of personal data and the de facto monopoly position of a number of digital platforms. As a result, directions for improving legal regulation are proposed, including the need for legislative detailing of pricing control mechanisms, terms of public offer and requirements for digital educational products. The findings can be used in the development of new bylaws, the adjustment of current legislation and the formation of public policy in the field of digital education, aimed at ensuring equity, equal access and protection of students' rights.

The rights and legitimate interests of the personal data operator

Davymoka S.V.

Abstract

the article examines the legal nature of the legitimate interest of a personal data operator as a basis for processing personal data without the subject’s consent, as established in Part 7 of Article 6 of the Federal Law “On Personal Data” [1]. The heightened attention to this issue is driven by the significantly strengthened administrative liability measures introduced in 2025 for violations in the field of personal data processing, including liability for large-scale data breaches. The author analyzes the conditions under which the processing of personal data without the subject’s consent is permissible, considering the need to observe the principles of legality, proportionality, and the inadmissibility of violating citizens’ rights and freedoms. Based on a systematization of judicial practice, it is revealed that courts predominantly adopt a restrictive approach to interpreting the operator’s legitimate interest, except in cases where such interest derives from other substantive legal norms (for example, in bankruptcy cases or in the protection of corporate rights). The research is based on the provisions of Russian legislation, as well as an analysis of key court rulings that shape the approach to the implementation of Part 7 of Article 6 of the Personal Data Law [1]. The author concludes that it is necessary to provide a regulatory clarification of the concept of “legitimate interest” and to develop a consistent law enforcement doctrine to ensure a balance between the protection of personal data and the legitimate interests of data operators.
