On Some Aspects of Correlation Between International and Domestic Law: a Study of Relations Between the Constitutional Court of the Russian Federation and the European Court of Human Rights
Аннотация
This article deals with some problematic issues of correlation between the international and domestic law, considering relations between the Constitutional Court of the Russian Federation and the European Court of Human Rights. The author pays special attention to the Ruling of the Constitutional Court of the Russian Federation of July 14, 2015, No. 21-P, which started a new stage in the development of legal practice on the issues of correlation between the domestic and interstate justice as well as the international and national law in general.
Circumstances Excluding Participation of the Defense Lawyer in Criminal Proceeding: Current Issues of Law Enforcement Practice
Аннотация
The article considers the circumstances excluding participation of the defense lawyer in criminal proceeding under Part 1 of Section 72 of the Criminal Procedure Code of the Russian Federation. The study of published court rulings (the Supreme Court of the Russian Federation, the Supreme Court of the Republic of Mordovia, the Nizhny Novgorod Regional Court) shows the topical aspects of law enforcement practice on the issue under consideration.

The article considers the functions, jurisdiction and structure of the qualification boards of judges of the Russian Federation. The author studies the relations of the Higher Qualification Board of Judges and the regional qualification boards of judges. The need of an open access to the decisions of the qualification boards of judges is proved.

The article presents an analysis of the causes of insolvency of management companies in the housing and utilities sector. The analysis shows that the insolvency problem is rooted both in the management decisions and the imperfection of the housing law.

The article considers some issues of legal regulation of capital repair of apartment buildings. The authors analyze the problem of economic inexpediency of capital repair fees, the problem of collecting such fees for apartments owned by the state and municipal authorities as well as the problem of opening and functioning of the bank account for capital repairs.
