Democracy or legality of the procedure of restriction of rights and freedoms when carrying out some special investigative activities in the Russian Federation

Abstract

Analyzed procedures for conducting of special investigation activities, which may limit the rights of man and of the citizen and requires a court order. It is concluded that the need to consider the issue of “democracy of procedure” (as an evaluation category) in the analysis of the category “legality of the procedure” as a regulatory instrument should be taken on the basis of the triad of entities: the state – person (citizen) – society. It is claimed that justice is carried out in two hypostases: as adoption of the fair law, and it is abstract justice and as implementation of this law that is the embodiment of concrete justice. The state, proceeding from regulations of the Constitution of the Russian Federation (articles 2, 17, 45 (part 1), 55 (part 2), etc.), is obliged to protect the rights and freedoms of the person and the citizen and shall not proceed from assumptions on error of application of federal laws by executive bodies. The last phrase also hides the problem posed by the inequality of democracy (as a balanced interest for the activities of the three parties) and the legality of the procedure (as compliance with established rules for resolving conflicts between the parties). Risks of recognition unconstitutional results of investigative activities are obvious in this connection it is offered to consider in a complex overcoming of obstacles on the way of an assessment of their “democratic procedure” and to make a number of changes to the federal law “on investigative activity”.
